2010 House Bill 2814: Providing for health care liability reform

Exempts medical practitioners from several liability in noneconomic damages. Prohibits someone from suing for medical malpractice if the act occurred more than 3 years before the claim, unless fraud can be determined as the impetus for the alleged crime. Reasonable attorneys fees will be reimbursed for the medical practitioner who is being sued for malpractice if he or she is able to obtain a summary judgment or voluntary dismissal. The bill also requires the court hearing a medical malpractice crime to allow for periodic payment of damages if the losing side requests to pay that way. The bill further allows for medical practitioners being sued to offer an early settlement. It also creates a program that would offer business credits to practitioners who serve uninsured as well as Medicaid and Medicare patients.   Official Text and Analysis.
