2005 House Bill 1482: Regarding child abuse

To revise provisions on child abuse and neglect. This bill modifies the state law regarding the definition of child abuse and neglect. The bill also establishes a procedure whereby hospital administrators and licensed physicians may file dependency petitions if they believe that such a move is necessary to protect the child from abuse and neglect or safeguard the child from future abuse and neglect.   Official Text and Analysis.

To add the requirement that when the court orders a dependent child be returned to, or remain in, the child's home the in-home placement is contingent upon the parents compliance with the case plan and court order. The parents' noncompliance with the case plan, court order, or treatment may be grounds for removal of the child from the home, subject to review by the court. The amendment makes other changes as well.
