2007 House Bill 1011 (Revising provisions relating to alien firearm licenses.)

  • Introduced by Rep. Jim Moeller, (D-Vancouver) on January 1, 2007, to revise provisions relating to the application procedures for receiving an alien firearms license. The bill would require the local police or sheriff’s office to issue an alien firearm license to a nonimmigrant alien resident within sixty days of application. This bill applies to firearms used for hunting or sport shooting. Violators would be subject to a class C felony.

It may sound petty, but why are we required to spend money on stamps to send in our ballots? I always thought that it was a right to vote and that I should NEVER have to pay ANYTHING for that right (although I did my service in the Army)so why are we Washington state residents required to put a stamp on the return envelope containing our ballot? It even says "First class postage required" right on it! Shouldn't this fall under the same heading as "Business reply mail"? Just curious.... any other states have to do this?

This State needs a political REHAB. Another example of the looney liberal left. I went around in circles for over a year just trying to get the right to duck hunt with my son. I pay my taxes, lots of them. Cant vote. But my wife can. And she will.

As a fully legal, permanent resident of this country, and having recently moved to this state I am horrified to find out that I cannot pursue my favorite sport without a piece of paper which is impossible to get (and which I would get if it were possible, despite it being a farce). I have been fingerprinted, background checked, measured, interviewd and checked for diseases to find even the tiniest issue with my character in order to achieve my permanent residency - in short I'm as upstanding a person as you're likely to meet and I'll be applying for citizenship in a few years when I qualify, at which point I shall pursue a place on the US Olympic shooting team. With any sense of legal decency the law will be struck down after today's ruling by the Supreme Court - permanent residents have constitutional rights unless federal law explicitly excludes them from a specific clause.

I have found that many Washingtonians are not clear about 'aliens' and we need to define terms.
A green card holder like myself cannot apply for citizenship until a certain amount of time has passed, so legal aliens are not 'avoiding' becoming citizens.
Some 'aliens' are here legally but are not legal residents - for example, if Tony Blair came here on holiday he could not accept an invitation to go clay pigeons shooting with his hosts
Green card holders have already had interviews by the U.S. government offices /Embassies and have had physical examinations by government approved doctors and mental assessments and FBI investigations into them and their family. They have been measured and weighed and photographed and fingerprinted and had blood samples taken.
Why cannot the Washington Licensing authorities accept people who have had this level of scrutiny already ? If they would, then it would not solve the whole problem but it would be a good start.

Every legal 'alien'in Washington is very much against illegal immigration but many Washingtonians immediately think of illegals when they think of 'aliens'. I pay Federal tax on my world wide income just like a citizen and spend all my income into the Washington economy

The history of Washington State with it's treatment of Asians many years ago where they were not allowed to buy property or even rent is a thing of the past and all countries have regretable episodes in their pasts, including my own. Those episodes make it more important that issues regarding LEGAL 'aliens' should be treated in a modern and more enlightened fashion and Washington has an opportunity to do that at zero cost, allowing freedom only to responsible, validated, legal aliens.

Come on Washington; shows like 'Frazier' promoted Seattle as modern and sophisticated, so let's get the laws up to date so that image of the State is promoted and not undermined by these hang-overs from the past

So long as the changes benefit Washingtonians and keep them safe then there is no reason to hang back. The extra revenue will pay for the Police to crack down more on illegals and criminals.

I am moving to Washington in 3 weeks as I am retired and my U.S. Citizen wife has a new job there. I was the Secretary of a target rifle club in the U.K. for 14 years. Seems these old Jim Crow laws still exist and will bar me from target shooting so I can just sit at home and watch Oprah.
I would not be in favor of the thousands of Americans U.K. being denied equal rights or African countries barring Americans from hunting there.

My wife is most dismayed as she has the choice of making her husband into 'untermensch' something less than other men, or giving up a great job in Washington State. We had researched Washington and decided it was progressive and enlightened - were we wrong ? Tony Blair could not shoot clay pigeons in Washington but O.J. could buy a pistol ?

This is one millionth of the harm that was done to black people by these Jim Crow laws but it gives me a tiny insight into what went on and is still going on

Dear Anonymous Citizen,
I agree, non-immigrant alien is an oxymoron, but refers to a person who enters on a visa with intention for applying for permanent residence. In my case, I entered on such a visa before marrying my wife and then applied for adjustment of status to permanent resident - I guess now I am a immigrant alien! The Alien Firearms Licensing has been a cause of great frustration for me, limiting my recreational choices and participation in my chosen sport - Olympic Trapshooting. I urge support for this bill, to rectify the issues outlined above, and wish to reiterate the respondents point on the 'hoops' that legal permanent residents go through to enter this country. Fingerprints, Biometrics, multiple interviews and background checks especially in the post 9/11 world are par for the course, another less rigorous check seems to serve little purpose. Regards.

Right now the situation with obtaining an alien firearm lisence has been cleverly stalled due to the fact that owing to legislation a local police law enforcement body eg Washington State police in any district is not allowed to request any background information from the FBI on a person because of the 'privacy' law that states that the one agency cannot divulge its information to another. This means that all the background checks cannot be completed and therefore an AFL cannot be processed until a new bill goes through government allowing information to be released to a third party. This is very unlikely to happen or be approved therefore AFL s may be a thing of the past! How then is a local Law enforcement agency got to get info on a potential criminal from the FBI? Being a permanent legal alien resident in WA i feel very upset that i have been put into the category of wait and see. On the good side it will prevent certain 'mall shooters' of late from wreaking havock in this great country.--Regards jojerrydavies@hotmail.com

Having been a permanent resident alien living in the state of Washington for more than 20 years I would welcome this change! The current alien firearms laws have frustrated me since their introduction. To become a permanent resident alien, one has to have a background check performed, has to be fingerprinted, and has to go through a waiting period. Also, to remain a permanent resident, one cannot have any felony convictions on his or her record. Why would the State have to impose additional requirements on permanent resident aliens over ordinary citizens?

Sounds like Rep. Moeller should be awarded the trophy for the most ingenious oxy-moron of the month or should it be classed as a euphimism for illegal alien? If this is the case, then Rep. Moeller should be kicked out of office and sent back to whatever he was doing before he fooled his constituents to vote for him.

Rep Moeller should be praised for his insight on this issue. I bet Harold doesn't realize that Trap, Skeet, & Target shooting are highly competitive Olympic sports. Most people do not know that shooting competitions are long time Olympic sports because our american news media is so biased they will not cover Olympic shooting events. The way the laws read in the state of Washington right now, it would be impossible to hold the Olympics here in Washington because foreign competitors could not even bring their guns here to compete. The federal government already has federal restrictions on illigal importation of firearms. However federal laws allow legitimate hunters and competitive shooters to enter the country for legitimate purposes. To my knowledge, Washington is the only state where residents of this state can go compete in Olympic shooting events around the world or hunt in most other countries of the world, yet residents of those same countries can not come and compete in shooting or hunting events here in Washington. Rep Moeller's legislation is very insightful and geared to resolve this hipocritical situation.

Please understand this issue has nothing to do with allowing terrorists to bring guns in the state. If terrorists want to bring guns they will just import them in containers or something like that. Terrorists are not being invited by the local gun club to come and compete at an organized competitive shooting event. Only persons approved by proper authorities could come and compete in legitimate shooting activities.
